In these Terms, "we", "us", and "our" mean Essendon Premium Residential Painting. "You" means anyone who uses our websites or services.

02 Acceptance of These Terms

By visiting our websites, submitting an enquiry, or engaging us for any service, you confirm that you:

• Are at least 18 years old, or have the consent of a parent or guardian
• Have the legal capacity to enter into a binding agreement
• Have read, understood, and agree to be bound by these Terms and our Privacy Policy
• Will provide accurate and truthful information when you contact us

We may update these Terms from time to time (see Section 13). The version in effect when you submit an enquiry is the version that applies to that enquiry.

03 Our Two Services

Essendon Residential Premium Painting

Through this brand, we provide painting services directly to residential customers in Melbourne. We are the painter. We carry the work, we manage it, and we are responsible for the quality of the work we perform.

Melbourne Paint Pros

Through this brand, we operate an introduction service. We do not perform painting work under this brand. Instead, we receive enquiries from people who need painting work, assess them, and refer them to a Partner Painter from our verified network. The painting work itself is then carried out by the Partner Painter under a separate agreement directly between you and that painter.

04 Quote Requests Through Essendon Residential Premium Painting

When you request a quote from us directly:

• We will respond within a reasonable time, usually within 24 to 48 business hours
• Any quote we provide is valid for 30 days unless we say otherwise in writing
• A quote is not a contract. A binding contract for painting work is only formed when you accept the quote in writing and we acknowledge acceptance
• The scope, price, materials, and timing of the work will be set out in the accepted quote and any related work agreement
• Once work is agreed, we will perform it with reasonable skill and care, in accordance with applicable Australian standards and Victorian regulations

05 Painter Introductions Through Melbourne Paint Pros

What we verify before referring a Partner Painter

Before adding any painter to our verified network, and from time to time afterwards, we take reasonable steps to confirm the painter holds:

• A registered Australian Business Number (ABN)
• Current public liability insurance appropriate to residential painting work
• Any registration or licensing required under Victorian law for the type of work they undertake

This verification is based on documents the Partner Painter provides to us. We rely on those documents being current and authentic.

What we do not guarantee

While we curate our network carefully, Melbourne Paint Pros is an introduction service. We do not:

• Guarantee the quality of any painting work performed by a Partner Painter
• Guarantee that a Partner Painter will start, attend, or complete work on any particular date
• Guarantee any specific price, scope, or outcome — these are negotiated directly between you and the Partner Painter
• Act as a party to the painting contract between you and the Partner Painter
• Hold or process any payment for the painting work (you pay the Partner Painter directly)

Your contract is with the Partner Painter

Once we introduce you, any agreement you reach about quote price, scope, schedule, materials, payment, or warranty is a matter between you and the Partner Painter. You should ask the Partner Painter for a written quote, and ideally a written work agreement, before any work begins.

06 Your Responsibilities

When using our services you agree to:

• Provide accurate, current, and complete information in any enquiry or form
• Treat our staff and any Partner Painter with reasonable courtesy
• Provide reasonable site access for any quote inspection or painting work that has been agreed
• Pay any agreed invoice (whether issued by us or by a Partner Painter) by the due date
• Not use our websites for any unlawful purpose, to harass, or to submit false or fraudulent enquiries
• Not attempt to bypass, scrape, copy, or interfere with the technical operation of our websites

07 Complaints About a Partner Painter

If a Partner Painter we introduced fails to contact you, treats you unprofessionally, or you have a serious concern about their conduct, please tell us at info@essendonpainting.com.au with the subject "Partner Painter Complaint".

We take feedback about our network seriously. We will:

• Acknowledge your complaint within 7 days
• Contact the Partner Painter to investigate
• Where appropriate, remove the painter from our verified network
• Where applicable, introduce you to a different Partner Painter at no additional cost

For disputes about the painting work itself (price, quality, completion, defects), the appropriate dispute resolution path is between you and the Partner Painter. Useful options include:

• Consumer Affairs Victoria — for consumer disputes about Victorian tradespeople: consumer.vic.gov.au
• Domestic Building Dispute Resolution Victoria (DBDRV) — for domestic building disputes
• Victorian Civil and Administrative Tribunal (VCAT) — for binding determinations

08 Limitation of Liability

Subject to the warning above, and to the maximum extent permitted by law:

• We are not liable for any loss, damage, delay, defect, or dispute arising from work performed by a Partner Painter under a contract between you and that Partner Painter
• We are not liable for any indirect, special, or consequential loss (including loss of profit, loss of opportunity, or loss arising from delay) howsoever caused
• Where we are liable for a breach of these Terms, our total liability to you is limited to either re-supplying the relevant service or refunding any fee you paid to us for that service, at our option
• We are not liable for any loss caused by your provision of inaccurate or incomplete information, or by your failure to follow reasonable directions from us or from a Partner Painter

09 Website Content and Intellectual Property

All content on our websites — including text, images, logos, layout, code, and design — is owned by Essendon Premium Residential Painting or licensed to us, and is protected by Australian and international copyright laws.

You may view and print pages from our websites for your own personal, non-commercial use. You may not:

• Reproduce, republish, or distribute our content without our prior written consent
• Use our trading names, logos, or branding in any way that suggests affiliation, endorsement, or partnership without our written consent
• Use our content to train machine learning or AI models without our prior written consent

10 Third-Party Links and Tools

Our websites may contain links to third-party websites or use third-party tools (such as Google Maps, social media widgets, or chat services). We do not control these third parties and are not responsible for their content, privacy practices, or availability. Your use of any third-party site is at your own risk and subject to the third party's own terms.

11 Privacy

We handle your personal information in accordance with our Privacy Policy, which forms part of these Terms. By using our services, you consent to the collection, use, and disclosure of your personal information as described in that policy.

12 Suspension and Termination

We may decline to respond to an enquiry, refuse to provide a quote, decline to introduce you to a Partner Painter, or remove your access to any part of our websites if we reasonably believe:

• You have provided false or misleading information
• You have engaged in abusive, threatening, or unlawful conduct
• You have breached these Terms in a material way
• Continuing to engage with you would expose us, our staff, or a Partner Painter to unreasonable risk

We will normally explain the reason if we take this step, unless we are prevented from doing so by law.

13 Changes to These Terms

We may update these Terms from time to time to reflect changes in our services or in applicable law. The "Effective" and "Last updated" dates at the top of this page show when the current version came into effect.

If we make material changes that significantly affect your rights or our obligations, we will take reasonable steps to notify you — for example, through a prominent notice on our website. Continuing to use our services after a change means you accept the updated Terms.

14 Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Victoria, Australia. Any dispute arising in connection with these Terms or our services will be heard in the courts and tribunals of Victoria, Australia, and you and we submit to the non-exclusive jurisdiction of those courts and tribunals.

15 General Provisions

• Severability: if any part of these Terms is found to be invalid or unenforceable, the rest remains in full effect
• No waiver: our failure to enforce any right under these Terms is not a waiver of that right
• Entire agreement: these Terms and the documents they refer to (including the Privacy Policy and any accepted quote) form the entire agreement between you and us about our services
• Assignment: you may not transfer your rights under these Terms to another person without our written consent. We may transfer our rights and obligations to a successor business
